Bailey Law Firm Demands Justice and Legislative Change for SC Family
Kartrez Rush was driving home with his wife, Jasmine, and their three children when everything changed.
Flashing blue lights signaled what looked like a routine traffic stop, but instead, officers drew their guns, forcing Kartrez and Jasmine to walk backward toward them, fearing for their lives.
“What if one of them shot me in front of my kids?”
This wasn’t a movie scene; it was a devastating reality that unfolded in Sumter County. Bailey Law Firm announced a federal civil rights lawsuit against the South Carolina Department of Public Safety (SCDPS) and the state trooper involved, pushing for absolute accountability for the trauma inflicted on this family.
A Dangerous Stop Based on a Baseless Rumor
The justification for this extreme, armed response is chillingly absurd.
A random 911 caller told dispatchers that he “heard” from someone else that the car he was following had stolen dirt bikes. The caller couldn’t even make out the license plate tags on the vehicle he was trailing.
Despite this, law enforcement escalated a basic officer contact into a dangerous, high-risk felony stop. The trooper did no independent police work. Relying solely on an unverified, third-hand rumor from a caller who couldn’t identify the vehicle, the trooper pointed a loaded weapon at a car carrying innocent children.
Investigating “Swatting”
We are aggressively investigating whether this was a deliberate swatting incident. If it were, that caller must be held criminally responsible for putting a family’s lives in jeopardy. People are losing their lives over fake calls, and law enforcement cannot blindly escalate situations based on hunches and unverified tips.
A Lawsuit Isn’t Enough: South Carolina Must Act
While we fight for the Rush family in federal court, a lawsuit isn’t enough to fix the underlying issue.
Last year, South Carolina introduced a bill that would have made swatting a crime with real, severe penalties. It died in committee. The terror the Rush family experienced is exactly why that bill needs to be revived and passed immediately.
Pushing for Accountability
No family should ever have to experience the terror of being held at gunpoint on the side of the road because of a false tip and reckless police work.
At Bailey Law Firm, we pray for peace and healing for our clients, but we also aggressively pursue accountability. We are working to reform the system to ensure this never happens to another family on the road.
